MEMO to my Locals folks.
At the close of the State’s case, here is a summary of some of the problematic points in their narrative of guilt, IMHO
I. Hypothetical wherein Alex is innocent.
A. The shooter is lying in wait for Paul with a double barrel shotgun.
B. Killer waits until Alex leaves to go home.
C. Killer then surprises Paul who has an AR-15 in 300 BLK.
D. Paul is then killed with shotgun.
E. Killer takes Paul's AR and hunts down Maggie, who he observes trying to video him with cell phone.
F. Once she is dead, he takes cellphone and two guns, and tosses the cell as he leaves.
G. And also, why is this scenario not possible, given the utter lack of a coherent motive on Alex's part and lots of enemies of Murdaugh family and Paul in particular.
II. Crime details.
A. Crime occurred June 7, 2021 between 8:44 pm and probably 9:06 pm but maybe as late as 10:06 pm
B. That is a 22-minute window for the killer.
C. 8:49:27 State says this is the last cell activity for victims.
D. Evidence 27: 9:02:18 and 9:06:47 Alex’ phone records 283 steps
E. 9:06:12 Wife’s phone last orientation change
F. 9:06:48 Alex starts his Chevy Suburban.
G. Maggie’s cell does not connect with Suburban in June.
III. Questions about tracking and times.
A. Question: Are the step counters accurate or not?
1. as to times and
2. as to recording steps
B. Question: Are the time stamps accurate or not?
1. as to cell phones,
2. as to vehicle
C. Question: What is the meaning of the cell phone orientation change?
D. Question: How does cell phone locking affect the transmission and recording of data?
E. Question: How does Paul’s low battery affect the video posts and times?
F. Question: How does lack of cell coverage in the area affect the video posts and times?
IV. Reasonable doubts:
A. Why, if it was Alex, did he use two guns?
B. Why not just one shotgun with eight rounds? Is this not more consistent with a double barrel?
C. Why, if it was Alex, did the ejected shell casings land INSIDE the room. From the position of the shotgun as testified by police experts, the shell casing would not have landed there. Is this not consistent with a double barrel that ejects backwards on reload as the killer turns and sees Maggie and attempts to reload a double barrel?
D. How does the State explain the 9:06:12 last orientation change on wife's phone and the 9:06:48 Alex car start?
E. Why do the step counters on Alex' phone and Maggie's phone not sync up when supposedly Alex is carrying it?
F. Why does Maggie's phone register a certain number of steps, supposedly made by the killer, and not recreate those steps back to the house? Perhaps because these steps are also consistent with the killer transporting the phone to the side of the road to a waiting car?
G. It seems that the killing happened between 8:44 pm and 9:06 pm. That is a 22-minute gap. Is that not also consistent with the alternative theory laid out above?
H. The State posits that the killings happened at 8:49 pm based on the last cell phone data from Maggie and Paul. Is that a proper deduction?
I. If this was Alex, was it heat of passion or methodical?
1. If it was heat of passion, do you think Alex’ demeanor throughout his life as testified to in this case properly reflect his persona? Is this level of planning consistent with the heat of passion?
2. How can a man with such a love for his family that he wanted to kill himself so that his remaining son could get insurance money kill the other two most loved people in his life?
3. If it was a methodical killing, why use an AR-15 he owned? Why not buy a black-market weapon?
J. Why not produce a better alibi? He could have just slept the whole time, right?
K. Why did the State present at least two bits of perjured testimony to the grand jury in order to get an indictment? Namely that the other guns on the property were loaded with the same loads, and that Alex had DNA blood spatter on his shirt?
L. Why did the State not produce a coherent narrative of guilt?
M. Why did the State present such an unclear and confusing case?
N. Why did the State focus so much on financial crimes, drug use, and later suicide attempt? Is this really a coherent motive or was the State simply constructing a motive to admit the other crimes and paint Alex as a “bad guy”?
O. Why did the prosecution project an imagined body check scenario onto Alex when they have no evidence of how he performed this action?
P. Why did the prosecution misconstrue a statement by Alex as a confession when it clearly was not?
Q. Why did the prosecution create evidence of the gunshot residue laden blue tarp? is the gunshot raincoat/tarp relevant when it was recovered weeks later, and is not consistent with what the housekeeper saw?
R. Can we admit that the SLED messed up the early crime scene by failing to preserve evidence properly? including tire track evidence and Alex’s parent’s home.
S. Why are the State SLED witnesses unwilling to answer direct questions on cross without becoming defensive? Why, as supposed impartial investigators, do they have a dog in the fight?
T. Are Alex's minor statements more attributable to shock and panic and the imperfection of memory in high stress environments than malice?
